What these terms cover, and what they do not

These terms cover your use of this website.

They are not the contract for buying a vehicle. If you buy from us, that purchase is governed by the bill of sale and the other purchase documents you sign at the dealership. Where those documents and these terms disagree, the signed documents govern.

Vehicle listings, prices and availability

We work to keep our inventory accurate and current, but listings are information, not an offer to sell.

Vehicles are subject to prior sale, and one shown on the site may already be sold or on hold. Prices are in Canadian dollars and do not include GST, financing costs, or optional products you choose to add.

Errors happen. If a price, specification, mileage or other detail is wrong, we may correct it and decline a request based on the incorrect information. We will tell you if that happens.

Photographs and vehicle descriptions

Photographs show the actual vehicle unless a listing says otherwise. Colour can look different from screen to screen. Descriptions and equipment lists come from vehicle data providers and can contain errors, so please confirm anything that matters to your decision before you buy.

Vehicle history reports

Where we link to a Carfax report, that report is prepared by Carfax from records it receives from third parties. We do not create it and cannot guarantee it is complete. An incident that was never reported to those sources will not appear on it. We encourage you to inspect any vehicle, and to arrange your own mechanical inspection if you wish.

The payment calculator

The payment calculator is an estimating tool. Its figures are illustrative only, are not an offer of credit, and do not include taxes, fees or optional products. Your actual payment depends on the rate, term and amount a lender approves.

Financing applications

Submitting a financing application asks us to send it to third-party lenders on your behalf. It is not an application to us, and it is not approval.

Approval, the interest rate and the terms are decided by the lender, not by us. Lenders will normally check your credit. We do not guarantee that an application will be approved, or that a particular rate will be offered.

Trade-in estimates

A trade-in figure given through the website is a preliminary estimate based on what you tell us. It is not a binding offer. Any final trade-in value depends on our physical inspection of the vehicle, its condition and current market conditions, and requires proof that you own it.

Requests to source a vehicle

If we agree to look for a specific vehicle through our network, that is an effort to find one. It is not a promise that we will, or that it will be available at a particular price.

How we contact you

When you give us your phone number or email, you agree that we may contact you about your request by phone, text message and email. Message and data rates may apply to texts.

You can stop marketing messages at any time by replying STOP to a text, using the unsubscribe link in an email, or emailing sales@happycornerauto.ca. We may still contact you about a transaction already under way.

Using this website

You may browse the site and use its forms for genuine personal inquiries.

• Do not submit false information, or anyone else's information without their permission.

• Do not scrape, copy or republish our inventory, photographs or content for a competing service.

• Do not attempt to disrupt the site, reach parts of it you are not meant to reach, or upload anything harmful.

Our content

The text, layout, photographs and logos on this site belong to Happy Corner Auto or are used with permission. Third-party marks such as Carfax, CarGurus and vehicle manufacturer names belong to their owners. You may not reuse our content commercially without our written permission.

Links to other sites

We link to services such as Carfax and CarGurus. We do not control those sites and are not responsible for their content, or for how they handle your information.

The website is provided as is

We provide this website on an as-is basis. We do not promise it will always be available, error free or uninterrupted, and we do not warrant the accuracy of the information on it.

This section is about the website. It does not affect any warranty that comes with a vehicle you buy from us, whether written, implied by law, or from a manufacturer.

Limitation of liability

To the extent the law allows, Happy Corner Auto is not liable for indirect or consequential loss arising from your use of this website, such as lost time, lost profit, or loss arising because a listing was inaccurate or the site was unavailable.

Your consumer rights

Nothing in these terms removes or limits any right you have under Alberta's consumer protection legislation, AMVIC rules, or any other consumer protection law that applies to you. Where any part of these terms conflicts with those rights, those rights prevail.

Governing law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply in it. The courts of Alberta have jurisdiction.

If part of these terms cannot be enforced

If any part of these terms is found unenforceable, the rest stays in force.

Changes to these terms

We may update these terms. The date at the top of this page shows when they last changed, and the version on the site at the time you use it is the version that applies.
